By downloading, installing, or using FoodVue ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App after changes constitutes acceptance of the modified Terms.

2. Description of Service

FoodVue is a nutrition tracking application that uses artificial intelligence to help users log and track their food intake, calories, macronutrients, and health metrics.

The App is intended for general wellness and informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

3. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your login credentials secure and confidential
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized access

4. Subscription & Payments

Free Tier

Basic features are available for free with usage limits (e.g., 3 AI food scans per day).

Premium Subscription

Premium features require a paid subscription. By subscribing, you agree to:

• Pay the subscription fee at the start of each billing period
• Automatic renewal unless cancelled before the renewal date
• Manage your subscription through the App Store or Google Play

Refunds

Refund requests are handled by Apple or Google according to their respective refund policies.

5. Acceptable Use

You agree NOT to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or hack the App
• Interfere with or disrupt the App's functionality
• Upload malicious content or code
• Impersonate others or provide false information
• Use the App to provide medical advice to others
• Resell or redistribute the App or its content

6. Health Disclaimer

IMPORTANT: FoodVue is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

• Nutritional information is estimated and may not be 100% accurate
• AI food recognition is approximate and should be verified
• Calorie and macro targets are general recommendations
• Consult a healthcare professional before starting any diet or exercise program
• If you have an eating disorder, consult a medical professional before using this app

7. Intellectual Property

All content, features, and functionality of the App—including but not limited to text, graphics, logos, icons, images, audio, video, and software—are the exclusive property of FoodVue and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. User Content

You retain ownership of content you create (e.g., food photos, meal logs). By using the App, you grant us a license to use this content to:

• Provide and improve our services
• Train and improve our AI models (anonymized and aggregated)
• Generate insights and analytics

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOODVUE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, or goodwill
• Any damages resulting from your use or inability to use the App
• Any damages resulting from reliance on nutritional information
• Any health issues arising from diet or exercise changes

10. Indemnification

You agree to indemnify and hold harmless FoodVue, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the App at any time, without prior notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or the App
• Is fraudulent or illegal

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
